Position: Court Clerk/Director
Reports To: District Judge
Department: Tribal Court
FLSA Status: Exempt
Job Purpose: Responsible for the processing and maintenance of all legal pleadings filed before the Seminole Nation Tribal Court and the Seminole Nation Supreme Court.
Records all court proceedings. Reports to the Chief Judge and/or Court Administrator.
Job Duties:
Satisfactory job performance will be determined by successful execution of the following:
• Accepts and receives the filing of all legal pleadings. Notifies all parties of record regarding continuances, cancellations, rescheduling and other activities of the Court.
• Prepares and maintains files for all cases complete with all appropriate documents.
• Establishes and revises record keeping procedures, including tickler systems, to accurately track and maintain case-related matters and motions for the Tribal Court Judge or Supreme Court Justices. Provides up-to-date information on case status as requested by the Tribal Court Judge or Supreme Court Justices.
• Assists with the conduct of court proceedings, (conferences, prosecutor's pre-trials, hearings, arraignments, etc.). Records sessions, marks/stores files, exhibits, administers oath to witnesses and provides general administrative support.
• Prepares cases for closure ensuring files are complete with case summaries and related documentation.
• Assists litigants with proper forms, copies of relevant Tribal Law, etc., without giving legal advice. Responds to telephone and mail inquiries and private information on relevant cases as appropriate.
• Examines for correctness and logs/accepts Tribal Police Investigative Reports and accompanying documents or items.
• Drafts or assists with drafting forms, mailings, reports, etc.
• Maintains case management database. Prepares special reports and statistical information as requested.
• Records monies received and submit to the Court Administrator. Issues receipts to payees.
• To collect all fines, fees, and costs authorized or required by law to be paid to the court, and deliver them to the Treasurer of the Seminole Nation for deposit in the Court Fund.
• Oversees the development, guidance, and implementation of policies and procedures of clerk of court operations to ensure program success, uniformity, integrity, and quality control.
• Provides leadership and ensures uniformity of operations in Seminole Nation Tribal Court for clerk and court improvement program operations.
• Recommends policy changes to the Chief Judge.
• Reviews legislation for tribal impact and recommends implementation plans regarding passed legislation impacting clerk of court operations.
• Recommends training development specific to practices.
• Provides policy and program interpretation and guidance.
• Oversees the implementation of court support operations to ensure statewide uniformity and effective business processes.
• Promotes the philosophy and concepts that serve as the foundation for court support operations.
• Assists in developing the plan for changes and revisions to clerk of court operations.
• Provides guidance and assistance in the implementation of and maintenance of circuits.
• Plans or assists in strategic development planning for circuit operations.
• Oversees the management of the Domestic Violence Court docket and Juvenile Healing to Wellness court docket when implemented to ensure proper administration and compliance with grant goals and objectives.
• Developing and overseeing the budget for the District Court and Supreme Court.
• Processes incoming and outgoing mail daily.
• Perform other duties as assigned.
Knowledge, Skills and Abilities:
• Knowledge of legal language, spoken and written, including spelling, punctuation and grammar and basic arithmetic.
• Knowledge of standard office equipment and systems.
• Knowledge of techniques of filing and indexing alphabetically and numerically.
• Knowledge of principles of customer service and telephone etiquette.
• Knowledge of techniques of time management.
• Knowledge of appropriate Tribal Statutory Codes, Rules of Court and local rules relating to court procedures.
• Knowledge of established policies and procedures related to court proceedings, collections, legal procedures and documents used in court cases.
• Knowledge of legal terminology, common legal format requirements, laws, rules, regulations and legislation affecting the court.
• Knowledge of general court system policies and procedures related to legal processing.
• Knowledge of Tribal Court's personnel policies and procedures and courtroom protocol.
• Skill in examining documents for accuracy, completeness and conformity to requirements and take appropriate corrective action.
• Skill in appropriate discretion and judgment in handling sensitive personnel and court matters.
• Skill to prioritize workload and projects to ensure tasks are performed timely and accurately in accordance with predetermined deadlines, policies and procedures.
• Skill to perform multiple activities or assignments, often simultaneously, which require attention to detail and accuracy. Independently exercise good judgment in answering questions and releasing sensitive information.
• Skill to understand and comply with court policies, procedures and guidelines, and the Code of Ethics for Court Employees.
• Ability to learn computer software programs and application concepts necessary to perform assigned duties.
• Ability to plan, organize, coordinate and assist in the management of court clerks in assigned units or courtroom clerks in assigned courtrooms.
• Ability to reason analytically and organize facts; remember and apply complex rules, procedures and other detailed information.
• Ability to work independently, follow policies and guidelines, maintain confidentiality of court-related records, and use sound judgment in performing court related work.
• Ability to identify program and staffing needs, assist in formulating unit policies and procedures and developing and implementing program goals and objectives.
• Ability to correctly read, interpret and communicate laws, regulations, rules, legal procedures, court documents and other court matters to assigned staff and the public.
• Ability to work cooperatively and effectively with other court staff, supervisors/managers, administrators,judicial officers, and representatives from other governmental agencies and members of the public.
• Ability to communicate effectively, both verbally and in writing, with other court staff at various levels and the general public, sometimes under difficult and challenging conditions.
• Ability to understand and follow sometimes complex and written instructions; communicate and listen effectively.
Supervisory Functions:
This position supervises staff who are responsible for researching, developing, implementing, and ensuring uniformity in circuit clerks' functions; Domestic Violence Court docket and Juvenile Healing to Wellness court docket oversight and compliance when implemented; and record searches.
Work Environment:
• Work is performed in a typical interior/office environment.
• Duties of the position will require some travel to gather information, attend meetings, and provide training.
• In addition, out-of-state travel may be required to attend meetings and/or training.
Physical Demands:
In-state and out-of-state travel is required for meetings and training; attendance in accordance with rules and policies; sitting for extended periods of time; and operating office machines such as a computer, telephone, copier, etc. The incumbent is also
required to work effectively with coworkers, stakeholders, and the public; manage stress with a calm demeanor; meet deadlines and objectives; demonstrate initiative and motivation; and communicate (verbally and in writing) complex ideas, rules, policies, and procedures.
Minimum Oualifications/Reguirements:
• Associate's Degree in related field, but prefer Bachelor's Degree
• High school/GED and/or three (3) years of court clerk experience
• Thorough knowledge and understanding of policies and procedures of court system and a court clerk office.
• Customer service experience
• Basic Word and Excel skills
• Familiarity with Indian Law desirable.
• Knowledgeable in legal terminology.
• Indian Preference will be given.
• Valid Oklahoma driver's license with ability to meet Seminole Nation liability insurance requirements and maintain eligibility for insurance.
• Must be able to pass background check, with no prior convictions and/or felonies.
• Must be able to comply with the Seminole Nation Drug Free Workplace policies.
